During the luncheon recess on 0th October 000, students dismantled a college clock to the point that one of the dismantled parts was the clock face. The clock face was then used as a frisbee. Such a duty requires the schoolmaster to take reasonable steps to protect the pupil against risks of injury which the schoolmaster should reasonably have foreseen.


The Barristers of the defendant further argued that there is no duty to avoid all accidents or injuries which may befall pupils while they are in attendance at the school. It is not a duty to ensure against harm but rather it is a duty to take reasonable care to avoid harm being suffered.


The plaintiff's barrister then read out the policies of the school which stated that during all breaks the school yard should be adequately supervised. He further argued that if the yard had been supervised "adequately" then the pupils would not have had time to dismantle the clock.


6) The courts decision was as follows.


The judge held that a clock that size could be dismantled and thrown just shows the lack of supervision of the students in the school yard. The judge also stated that dismantling the clock would have taken a space of time which was longer than was required for its detection if a proper system of supervision or proper supervision per se had been in place at the time.


The court also held that it was reasonably foreseeable that once the clock face was removed from the clock it was likely to be thrown in frisbee mode by one of the students. He considered that the element of causation had been proved.


Damages the Plaintiff is entitled to recover damages representing fair and reasonable compensation for the pain and suffering and loss of enjoyment of life suffered by her in the past and in the future and for the physical damage caused by this incident as well as damages being reasonable compensation for the cosmetic disability which has resulted and which, as a matter of probability, will be permanent.


The plaintiff was awarded $4,584. The judge came to this figure by assessing damages and had arrived at the figure of $40,000 compensation for the Plaintiff in all the circumstances. To this sum he added total sum of $584 to represent the medical and like expenses which have been paid by the litigation guardian, a sum of $64 which must be repaid to the Health Insurance Commission and a sum of $500 which the judged assessed as the damage suffered by the litigation guardian in terms of loss of employment in order to care for the infant Plaintiff.

People thought this was an act of madness. The letter has a relation to the word, "American" in various ways. For one, America is a melting pot of many peoples and ideas, as was Hester's "A." She earned that "A" under certain situations. She was in a loveless marriage, she had been under separated from her husband for yrs. She was perceived and punished under a strict Puritan eye. Like the development of America, there were many conditions that led to the development to earn Hester her insanity, the "A" on her chest.


In a contradicting manner, her label on her chest also stood for the word "able." Hester Prynne was a very able woman. She was too strong of a woman for Puritan Boston right from the start. That was known from the very beginning of the novel when she faced the people of Boston with her sentence and her dignity. She always held her head high. She was able to accept her punishment. She was able to take with pride all the torment the townspeople could throw at her, giving her a divine sense of pride and self-importance. Hester was also an able mother, nurse and seamstress. Despite everyone's talk about Pearl, Hester never let that interfere with her mothering Pearl. She was able to bring up a strong daughter. Hester had a strong devotion to her work as a nurse. She also went on with her work as a seamstress. Hester's most important accomplishment was her ability to overcome her sentence. She accepted her sin and accepted herself. She learned to love who she was. By accepting herself other people began to follow her example and embrace who she was, not what she was labeled and thus the "A" she had worn converted from "adulteress" to "able" once she excepted who she was and the people had embraced that.


The most important symbol of the story, helped prove a once thought letter, existing to ensnare Hester in a never-ending circle of deception, to become something for more intimate and honorable. The protagonist, Hester Prynne wore the letter throughout the story, and the letter took every road that the story did. The letter became one with Hester and Hester became the meaning of the scarlet letter.

Hamlet Essay


Any given character can be viewed in more than one fashion and just as one interpretation may be common to many readers, others may hold a different point of view. Within Shakespeare's play Hamlet, the title character can be seen as either a man of action or a man or procrastination. Several believe that Hamlet was a weak man; a procrastinator, whereas other critics, like Werder, believe Hamlet to be a man of action with a different purpose. As the show progressed the King rose and Polonius, the King's lapdog, shouted for the lights to be turned back on and the play was stopped abruptly. This proved to Hamlet that the King was guilty because Claudius stood up and left the room after the actor poured the poison into the ear of the actor-King. After everyone left the room, Hamlet stated to his friend Horatio, "…, I'll take the ghost's word for a / thousand pound( III, ii, 80-81)". Hamlet realized that he would simply be rewarding King Claudius for his murderous deed by sending him to heaven instead of an eternity of unrest. On the second page of the novel, Nick comments that Gatsby "represented everything for which I have an unaffected scorn". (). Nick was referring to his disgust for the people and events he had encountered during that fateful summer. It is evident that Nick had conflicting and ambivalent feelings toward Gatsby. Nick both loved Gatsby and was critical of him. Nick was tolerant, but that toleration had limits. He hated Gatsbys crass and vulgar materialism. However, Nick also admired Gatsby for his dream, his romantic readiness, and his extraordinary gift for hope. Nick respected the romantic hope that motivated Gatsby to pursue his dreams. Nick valued Gatsbys hope, no matter how false it was, that one day he would have a life with the woman whom he loved, (Daisy). Wealthy people often use their money to get everything they have always wanted for themselves, but Gatsby used his money to get everything that he thought Daisy had always wanted in hopes of winning her back. An example of this could be all the beautiful shirts that Gatsby had bought. Gatsby believed in this possibility of romance, and even though the possibility was based on shallow material realities, it was motivated by his love of Daisy. It was selfish in a way, but Nick was able to appreciate the romantic aspect of it and therefore, able to see Gatsbys true greatness. As the summer progressed, Nick learned more about who Gatsby really was, or rather who he was not and reasons why he lived his life as he did. Nick did not approve of Gatsbys lifestyle or the way he earned his money. Although Nick came from a very wealthy family himself, he was taught to work hard for his money. However, Nick saw Gatsby as superior to those who surround him. Nick made the distinction between Gatsby, whom he loved because of his dream, and the other characters, which constituted the foul dust that floated in the wake of his dreams". (). Nick had such scorn for these Eastern types that he had left the East, returned to the Midwest, and, for the time being at least, withdrawed from his involvement with other people. Bibliography
